Welcome to imaxmall. These Terms and Conditions (“Terms”) govern your access to and use of imaxmall.com (the “Site”) and any purchase you make through it. By visiting the Site, creating an account, or placing an order, you agree to be bound by these Terms. Please read them carefully.

We may update these Terms from time to time to reflect changes in our practices or for legal and regulatory reasons. Updated Terms take effect when posted on this page with a revised effective date. Orders placed before a change are governed by the Terms in effect at the time of the order.

4. Account Registration

You may browse the Site without an account. To place an order or manage past orders, you may be asked to create one. You agree to:

5. Products and Pricing

We make every effort to display accurate product descriptions, images, and prices. Please note:

The presentation of products on the Site is an online catalog and is not a binding offer to sell.
Product colors may vary slightly from images shown because of screen settings, and minor specifications may differ by batch.
All prices are final prices listed in US Dollars (USD). The price shown at checkout, including shipping and all applicable sales tax, is the total you will pay. No additional fees, customs duties, or import charges are added after you submit your order.
Prices may change over time, but a change never affects an order you have already placed and we have accepted.
If a product is listed at an incorrect price due to an obvious error, we may cancel the affected order. If we do, we will notify you and issue a full refund to your original payment method.

6. Orders and Conclusion of Contract

When you click the order or purchase button at checkout, you place a binding order for the items in your cart and make an offer to purchase. An automated confirmation email confirms that we received your order, but a binding contract is formed only when we ship your items and send you a shipping confirmation. We may decline or cancel an order for reasons such as suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, you will receive a full refund.

7. Payment

Payment is due when you place your order using Visa, Mastercard, American Express, Apple Pay, or Google Pay, or at delivery if you choose Cash on Delivery (COD). All online transactions are processed over a secure, encrypted (HTTPS) connection. We reserve the right to exclude certain payment methods in individual cases. 8. Shipping, Delivery and Delivery Area

All orders ship within the United States from our U.S. warehouse to addresses in the United States. We do not currently ship internationally. Because orders ship domestically, no customs duties or import fees apply.

Standard shipping: free, with no minimum order value.
Processing time: 1-2 business days (Monday to Friday), already included in the total delivery time.
Estimated total delivery: 4-6 business days from the order date.
Order cut-off time: orders placed before 2:00 PM Central Time on a business day are processed the same day. Orders placed after the cut-off, on weekends, or on public holidays are processed the next business day.
Carriers: we ship with carriers such as USPS, UPS, and FedEx. Once your order ships, you will receive an email with your tracking number.

Delivery estimates are provided in good faith, but delivery dates are not guaranteed and may be affected by carrier delays or events outside our control. The available shipping options and costs are shown during checkout. For full details, please see our Shipping Policy.

9. Returns and Refunds

Eligible items may be returned within 30 days of delivery in accordance with our Refund & Return Policy, which forms part of these Terms. In summary:

Defective, damaged, or incorrect items: return shipping is paid by imaxmall, and you receive a full refund or a replacement at no cost.
Change of mind, wrong size, or no longer needed: return shipping is paid by the customer.
We do not charge restocking or processing fees for returns.
Refunds are issued to the original payment method after we receive and inspect the returned item.

10. Retention of Title

Ownership of the goods remains with imaxmall LLC until we have received full payment. For Cash on Delivery orders, ownership passes when payment is made at delivery.

11. Prohibited Uses

When using the Site, you agree not to:

Use the Site for any unlawful purpose or in violation of any applicable law
Attempt to gain unauthorized access to our systems, accounts, or data
Interfere with the security or proper functioning of the Site
Use bots, scrapers, or other automated means to access or extract data from the Site without permission
Submit false, misleading, or fraudulent information, including fraudulent orders or payment details

12. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of imaxmall or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

13. User Reviews and Content

If you submit a review, comment, or other content to the Site, you grant imaxmall a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You agree not to submit content that is false, defamatory, offensive, or that infringes the rights of others. We may remove content that violates these Terms.

14. Product Use, Warranty and Defects

Products sold on imaxmall are intended for their stated purpose only. Where a manufacturer provides a warranty, that warranty applies to the product. If an item has a defect, arrives damaged, or is not what you ordered, please contact us within 7 days of delivery at support@imaxmall.com and we will offer a replacement or refund as described in our Refund & Return Policy. If your delivery arrives damaged, please contact us right away with your order number and photos of the item and packaging.

To the extent permitted by law, we disclaim all other express or implied warranties. Some states do not allow certain warranty exclusions, so the above may not apply to you, and you may have additional rights that vary by state.

15. Limitation of Liability

To the fullest extent permitted by law, imaxmall is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products, including loss of data, loss of profits, or delivery delays caused by circumstances outside our control. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

16. Third-Party Links

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, privacy practices, or terms.

17. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

18. Termination

We may suspend or terminate your account or access to the Site if we believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties. Termination does not affect any order already placed and accepted.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nebraska and applicable federal law, without regard to conflict of law principles. If you are a consumer, any mandatory consumer protection rights provided by the law of your state of residence remain unaffected.
